The New York State AFL-CIO, representing 2.5 million union workers and their families as well as our retirees and their families supports the above-referenced legislation.
This legislation defines abusive work environment and creates a civil cause of action for employees to bring suit against employers found to have caused or maintained an abusive work environment.
Providing a safe and healthy work environment must be a priority for all employers. As such, employers are legally compelled to maintain workplaces free from safety and health hazards, workplace violence, sexual harassment and other dangers. One important category of harm that is currently not defined in law is workplace bullying.
Employees who are subject to workplace bullying experience serious harm as a result. This harm includes feelings of shame and humiliation, stress, loss of sleep, severe anxiety, depression, post-traumatic stress disorder, reduced immunity to infection, stress related gastrointestinal disorders, hypertension, and pathophysiologic changes that increase the risk of cardiovascular disease.
This legislation will provide legal redress for employees who have been harmed psychologically, physically, or economically. It will also provide legal incentives for employers to prevent and respond to mistreatment of employees at work.
Therefore, this Federation urges this bill be passed.
