President's Message
Protect Worker and Labor Rights From Federal Erosion

In recent years, a well-orchestrated and well-financed attack on fundamental labor rights, based on fringe political ideologies, has whittled away at the ability of the National Labor Relations Board (NLRB) to function objectively and fairly. That long-term trend has escalated into an outright attempt to dismantle and purposely sabotage the operations of the NLRB with the intent of interfering with workers’ rights.
To address this, this bill will clarify the jurisdiction of the New York State Public Employment Relations Board (PERB) regarding its responsibility to administer the New York State Employee Relations Act on private sector labor matters. This would allow PERB to have jurisdiction over organizing and related issues in instances where the NLRB has not successfully claimed jurisdiction over an employer, employee, trade, or industry.
This bill would also enable New York State’s long-established labor relations process to apply when the NLRB is unable or unwilling to function and perform its duties.
Much like many other rights that have been whittled away or eliminated at the federal level, the State of New York can step in to ensure that those rights are protected, and that workers’ voices are heard, with a reliable and fair process that safeguards their rights.
The right for workers to create or join a union of their choosing, to negotiate with employers for their terms and conditions of employment, and to have a voice of their own when it comes to their working conditions is a fundamental tenet of a democratic society. This basic right is enshrined and protected by the New York State Constitution and is a pillar of fairness and decency in our society.
Therefore, it is crucial for New York State to regulate and protect workers’ rights.
